Next Generation EU – Exception or Precedenet?
The colloquium examines whether NextGenerationEU should be understood as a one-off response to an exceptional crisis or as a precedent for the future financing and lasting transformation of the European Union’s fiscal constitution. It focuses on the repayment of common debt, the development of new own resources, and the resulting allocation of fiscal powers, risks, and democratic responsibility between the European Union and its Member States.
At the same time, it subjects the emerging EU fiscal capacity to a legal stress test by asking whether the Union could enter fiscal distress or default on its obligations, which claims would take priority, who would bear the resulting losses, and whether Union financial obligations would survive a Member State’s withdrawal under Article 50 TEU.
